FREE BOOKKEEPING SOFTWARE SELF-EMPLOYED Working for yourself is a big step, and although you may have great ideas and high hopes for your business, you will need the right advice and support behind you to make them come true. One of the most important considerations when becoming self-employed is tax. It can seem like a daunting process, but we are here to make things easy for you. Below is a basic guide to your tax obligations, but remember that although you have to self-assess, we can take care of the paperwork. You just need to keep records of your income and business expenditure throughout the year ready for us to work on. The tax that you owe in respect of a year’s income is due on the 31 January following the end of the year in which the income arises. You need to make payments on account by 31 January and 31 July each year. Any remaining tax liability, after taking into account the payments on account, is payable on 31 January the following year. With the advent of self-assessment, there are now fines and penalties for not submitting tax returns on time and these must be submitted by 31 January following the end of the relevant tax year. We can complete your self-assessment for you. Getting proper professional advice early is crucial in starting up a new self-employed business, as there are very strict Inland Revenue rules governing your actions. An example of this would be if someone works as an employee for a company and then announces that they are self-employed and continues doing exactly the same work in exactly the same manner. The Inland Revenue are likely to refuse the self-employed status, resulting in the usual PAYE and National Insurance liabilities. So discuss with a professional accountant what your tax status will be before starting out. Once you are running your own business, then there are a whole host of other implications. These cover other taxes such as VAT and National Insurance and, where you employ other people, employment law legislation that is increasing in complexity day-by-day. SJM Accounting is on hand to help. Our professional services for the self-employed will ensure you are fully compliant with the law and have all the advice and support you need. LIMITED COMPANY A limited company is a separate legal entity that has all the legal rights of an individual and is responsible for its own debts. It must also file tax returns and pay taxes on income and capital gains. The owners or shareholders of a limited company are usually protected from the liabilities of the business. However, when a limited company is small, creditors often require personal guarantees from the principal owners before extending credit. However, the legal protection afforded to the owners of a limited company can be beneficial. A limited company must file an annual tax return (corporation tax return) with the Inland Revenue. There are other advantages to incorporating your business, such as the ease of bringing in additional capital through the sale of share capital, or allowing an individual to sell or transfer their interest in the business. If you are considering incorporating, talk to us. Not only can we advise you on your legal and tax obligations, but we offer a straightforward, low-cost incorporation service to make your transition to limited company as simple as possible. In addition to dealing with all the administration and cost of forming a limited company, our full service includes: Initial advice on the corporate structure Assistance with the selection of a company name Registration with the Inland Revenue for tax purposes Registration with HM Customs & Excise for VAT purposes Setting up PAYE scheme for payroll purposes Setting up of the company’s statutory books PARTNERSHIP In a partnership, two or more individuals join together to run a business. Each of the individual partners has ownership of the business assets and responsibility for liabilities, as well as authority in running the business. The rights, responsibilities and obligations of partners are typically detailed in a partnership agreement. We can advise on the setting up your partnership agreement so both parties are protected. The principles of taxation that apply to partnership are very similar to those for a self-employed person. For example, you will need to keep accurate records of income and business expenditure. A partnership is required to file an income tax return but typically does not pay income tax; the information from the tax return is combined with the personal income of the partners to determine the overall tax liability. If you are unsure whether a partnership is right for you, we can help. We can advise you on the potential pitfalls and the benefits of a partnership, or if a limited company is an option you should consider instead.
